Thank you for choosing to be part of Ahora Inc. (“Organization”, “we”, “us”, “our”). We are committed to protecting your personal information and your right to privacy. When you visit our website https://www.ahoramoney.org (the “Website”), and more generally, use any of our services (the “Services”, which include the Website), we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please contact us immediately. 

This privacy notice applies to all information collected through our Services (which as described above, includes our Website), as well as any related services, sales, marketing or events. 

1. INFORMATION WE COLLECT 

We collect personal information that you voluntarily provide to us when you register on the Website, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Website or otherwise when you contact us. 

The personal information that we collect depends on the context of your interactions with us and the Website, the choices you make and the products and features you use. The personal information we collect may include the following: 

Personal Information Provided by You. 

We collect names; phone numbers; email addresses; contact preferences; billing addresses; debit/credit card numbers; and other similar information. 

Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information. 

Information automatically collected 

Some information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you visit our Website. 

We automatically collect certain information when you visit, use or navigate the Website. This information does not reveal your specific identify (like your name or contact information) but may include device and usage information, such as you IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Website and other technical information. This information is primarily needed to maintain the security and operation of our Website, and for our internal analytics and reporting purposes. 

Like many businesses we also collect information through cookies and similar technologies. 

The information we collect includes: 

  • *Log and Usage Data.* Log and usage data is service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our Website and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the Website (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings). 
  • *Device Data.* We collect device data such as information about your computer, phone, tablet or other device you use to access the Website. Depending on the device used, this device data may include information such as you IP address (or proxy server), device and application identification numbers, location, browser type, hardware model Internet service provider and/or mobile carrier, operating system and system configuration information. 

2. USE OF INFORMATION PROVIDED 

We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent. 

We use personal information collected via our Website for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a service agreement with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below. 

We use the information we collect or receive: 

  • To post testimonials. We post testimonials on our Website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update, or delete your testimonial, please contact us at contactus@ahoramoney.org and be sure to include your name, testimonial location, and contact information. 
  • Request feedback. We may use your information to request feedback and to contact you about your use of our Website. 
  • To manage user accounts. We may use your information for the purposes of managing our account and keeping it in working order. 
  • To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies. 
  • To protect our Services. We may use your information as part of our efforts to keep our Website safe and secure (for example, for fraud monitoring and prevention). 
  • To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract. 
  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond. 
  • Fulfill and manage your orders. We may use your information to fulfill and manage your payments and cancellations made through the Website.

  • To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

We may use information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Website, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent. 

3. HOW WE SHARE INFORMATION 

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations. 

We may process or share your data that we hold based on the following legal basis: 

  • Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose. 
  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests. 
  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract. 
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements). 
  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved. 

More specifically, we may need to process your data or share your personal information in the following situations: 

  • Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g. Google Maps API, Place API). To find out more about Google’s Privacy Policy, please refer to this https://policies.google.com/privacy.

5. WE KEEP YOUR INFORMATION SAFE 

We aim to protect your personal information through a system of organizational and technical securities measures. We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed 100% secure. You should only access the Website within a secure environment. 

6. COLLECTION OF INFORMAITON FROM MINORS 

We do not knowingly collect data from or market to children under 18 years of age. 

By using the Website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Website. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. If you become aware of any data we may have collected from children under age 18, please contact us at contactus@ahoramoney.org. 

7. CONTROLS FOR DO-NOT-TRACK FEATURES 

Most web browsers and some mobile operating systems and mobile applications include a DoNot-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice. 

8. UPDATES TO THIS NOTICE. 

We will update this notice as necessary to stay compliant with relevant laws. We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by posting the changes or notifying you directly. We encourage you to review this privacy notice frequently to be informed.

Terms of Service

AHORA INC. FINANCIAL COACHING SERVICES 

1. TERMS AND CONDITIONS

This Agreement (the “Agreement”) contains the rules that govern, where appropriate, the provision of financial coaching services to you by Ahora, Inc., a Massachusetts-based 501(c)3 organization.

2. COACHING SERVICES AHORA PROVIDES

Ahora’s personal financial coaching involves several steps. This Agreement is to confirm our mutual understanding of the goals and objectives of our commitment to provide you with personalized financial coaching and plan, as well as the nature of the services we will provide. We will prepare a personalized financial plan after the review and consideration of your financial objectives and goals.

3. FINANCIAL COACHING

Under Ahora’s financial coaching services, we will provide you with financial coaching and guidance about your finances. Depending on the plan selected, clients will have access to a budgeting tool, webinars and/or one-on-one access to an Ahora Financial Coach. Ahora will supply coaching and guidance, including budgeting, debt management, credit repair/building strategies, financial and general wealth building tips.

We will assist you in the decision-making process, suggest alternative recommendations to help you achieve your goals. The suggestions and recommendations included in your personal financial plan will be advisory in nature, based solely on the information you provide to Ahora.

Please note that Ahora cannot guarantee the performance or future outcomes of any banking product, or financial projections which are based on future assumptions and multiple variables.

If in the course of this engagement we become aware of a service you need that Ahora cannot provide to complete the engagement, we will coach you of what is needed and recommend other trusted service providers to supply the service you need.

Please note that you have the right to decline to engage such recommended service provider(s). If declining the service(s) compromises the recommendations we presented, we will revisit and revise the plan accordingly.

4. SERVICES NOT INCLUDED UNDER THIS AGREEMENT

Please note that Ahora Inc. coaches do not provide investment services or advice. Ahora Inc. does however, partner with trusted organizations that can offer clients pro-bono investment advisory to Ahora Inc. clients. Such pro-bono advisory shall be limited to Ahora Inc. clients who subscribe to Ahora Inc.

5. SERVICES NOT PROVIDED

Ahora Inc. does not offer investment management, legal, tax or accounting services.

6. YOUR REPRESENTATIONS AND ACKNOWLEDGMENTS

You represent and agree regarding the following to Ahora, here and throughout the term of this Agreement, and understand and agree that we are relying on these representations and agreements to support you with financial coaching services:

• You will provide us with the necessary information needed to provide you with the agreed upon services.

o Our coaching services are based on information provided by you regarding your goals and circumstances. We cannot offer guidance based on limited or incomplete information provided by you.

  • You are solely responsible for making all financial planning decisions and you are under no obligation to follow, either wholly or in part, any recommendation or suggestion provided by us.
  • We may perform similar service for other clients and may make recommendations to those clients that differ from the recommendations made to you.
  • We obtain information from a wide variety of publicly available sources and cannot guarantee the accuracy of the information or success of the advice which we may provide. The information and recommendations developed by us is based on our professional judgment and the information you provide to us.
  • We shall not be obligated to provide any services with or for you if, in our reasonable judgment, this would (i) violate any applicable federal or state law or any applicable rule or regulation of any regulatory agency, or (ii) be inconsistent with any internal policy maintained by us from time-to-time relating to business conduct with our clients.

7. FEES AND CHARGES

You agree to pay the applicable fee for your coaching services, tool and content provided by Ahora Inc. You may submit payment either on a monthly basis, or on an annual basis.

Fees may be paid through credit card or PayPal. In the event you cancel the service, you will no longer have access to the Ahora online tool, webinars, or coaches, etc.

To the extent you access our services through a mobile device, your wireless service carrier’s charges, data rates, and other fees may apply. As such, you (not Ahora Inc) are responsible for such charges.

7a. Plan Options. You will be charged monthly in advance for your plan. If you cancel or change your plan, the cancellation or change may not take effect for 30 days. You may cancel your plan by contacting the Ahora representative from whom you receive Coaching Sessions or directly via email, or phone.

7b. Authorization. You authorize Ahora to charge all fees for the plan you select.

7c. Payment Processing. Payment processing services for Ahora may be provided by our third-party payment processors, which may include Stripe Inc. (“Stripe”). The processing of credit card charges or credits, as applicable, relating to your use of the Service will be subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). You hereby agree to be bound by the Stripe Services Agreement, which may be modified by Stripe from time to time. You agree to provide Ahora and Ahora’s third-party payment processor with current, accurate, and complete information about you and your payment methods.

8. TERM AND TERMINATION

You may terminate this Agreement and any set of services under this Agreement at any time and such termination will be effective upon receipt of notification of such termination. We may also elect to terminate this Agreement or any set of services under this Agreement at any time, for any reason or no reason, within our sole discretion.

Termination of this Agreement will not affect (a) the validity of any action previously taken under this Agreement; or (b) your obligation to pay Ahora fees 30 days after you terminate.

9. MODIFICATIONS AND AMENDMENTS

Ahora may amend or change any terms of this Agreement. You acknowledge that we will generally not be required to obtain your consent for any amendments to the Agreement or changes to any services.

If at any time the terms, conditions or fees are not acceptable to you, you may terminate this Agreement after paying any fees or charges owed to Ahora. We may cancel or suspend your services at any time.

10. E-SIGN CONSENT

We would like to communicate with you using electronic means. When you agree to this Agreement and click the “I Agree” button, this tells us:

  • You agree to receive any electronic communication from us for any purpose;

  • You agree to receive an electronic version of any written notice or disclosures we

    must send you under law (“Legal Disclosures”); and

  • You understand that to receive Legal Disclosures, you must meet the requirements

    specified under Technology Requirements below.

    When we send electronic communication, including a Legal Disclosure, it may come in the form of an update to the Ahora Website or within the Ahora App; as an email, text, or communication on social media; as a notification on mobile, tablet, or wearable devices; or through other electronic means. When you sign-up to receive services from Ahora, we will request your mobile telephone number. We request this information in order to send you security confirmation text messages and information about our services.

    By clicking the “I agree” button below, you are telling Ahora that you consent and agree to accept and receive communications from us, including email, text message, calls and push notification to the mobile telephone number you provide to us. As part of this consent, Ahora, or someone on our behalf, may send you communications generated by automatic telephone dialing systems [and/or deliver prerecorded messages] that includes (i) security confirmation messages; (ii) communications about use and updates to our services, and (iii) other information concerning our services. Ahora does not charge you when we communicate with you via text message, but your phone carrier may apply standard text messaging charges and data rates.

    10a. Technology Requirements

    In order to receive electronic communications, including Legal Disclosures, you must have:

  • A computer or mobile device with an internet connection.
  • A web browser.
  • The ability to view and retain Portable Document Format (PDF) files.

  • A valid email address and phone number.

    We may change these requirements, but we will notify you promptly of any material changes.

    10b. Saving and Reviewing this Consent

    This consent can be printed and saved for your records.

11. OPTIONAL THIRD-PARTY SERVICES.

Ahora and third parties may make available integrations between the Service and third-party products or services, including plugins and related (“Third-Party Services”) that you may elect to use. Any use by you of such Third-Party Services is solely between you and the applicable Third-Party Service provider. Because the Third-Party Services rely on the Third-Party Service provider’s continued operation, Ahora does not warrant or provide support for Third-Party Services. Ahora is not responsible for any violations of applicable law by Third-Party Service providers, or for any liability arising from your use of Third-Party Services. Ahora does not guarantee the continued availability of any Third-Party Services (or any integration with Third-Party Services or related Service features), and if such Third-Party Services or related features are discontinued, you will not be entitled to any refund, credit, or other compensation.

12. DATA.

Ahora may collect and analyze data relating to your use of the Service that is aggregated in such a way that it is not associated with you and other information relating to the provision, use, and performance of various aspects of the Service and related systems and technologies (including information provided by third-party analytical tools). Ahora may analyze, process, collect, and use Usage Data for any purpose, including for improving the Service and developing new products, services, features, and functionality.

13. Consent to Electronic Communications.

a. Administrative Communications. By using the Service, you agree that we may communicate with you electronically regarding registration, security, privacy, and administrative issues relating to your use of the Service.

b. Coaching Session Communications. Coaching Sessions may take place over video conference on your personal device, in person, or over the phone.

c. Consent. You consent to receiving our email newsletter and other marketing-related emails from us. If you wish to remove yourself from our email list for such marketing- related emails, please use the unsubscribe link in any email received from us.
